⚾ Student Data Protection
MoveWell processes student data as a "school official with a legitimate educational interest" under FERPA (34 CFR § 99.31(a)(1)). Student data is treated with the same protections required of the contracting school or district itself.
🔒 Data Never Sold
Student data is never sold, rented, or made available to advertising platforms, data brokers, or third parties for commercial purposes.
🔒 No Profiling or Targeting
Student data is never used to build profiles for behavioral targeting, predictive analytics of student behavior, or any non-educational purpose.
🔒 No Third-Party Sharing
Student data is not shared with third parties without the express written consent of the school or district, except as required by law.
🔒 Encryption Standards
All student data is encrypted at rest (AES-256) and in transit (TLS 1.2+) using industry-standard encryption.
Permitted Uses of Student Data
MoveWell may use student data solely for the following educational purposes:
- Delivering curriculum content through the MoveWell platform
- Generating teacher-accessible reports on student engagement, lesson completion, and assessment performance
- Improving the educational quality of MoveWell lessons and platform features
- Aggregating and de-identifying data for platform improvement (de-identified data is not subject to FERPA/SOPPA restrictions)
- Complying with legal obligations applicable to the school or district
Prohibited Uses of Student Data
MoveWell expressly prohibits the use of student data for:
- Advertising or targeted marketing of any kind
- Building or marketing products or services to third parties
- Student profiling, behavioral prediction, or risk scoring
- Commercial research or data monetization
- Any purpose other than the educational services contracted for
⚾ Data Portability
Districts and schools have full access to their data at all times. Upon request, MoveWell will provide a complete export of all district data in a standard, machine-readable format within 14 business days of the request.
Data portability requests should be submitted by the district's authorized administrator. Export formats include:
- JSON — for technical integration with district systems
- CSV — for import into district-gradebooks or data warehouses
- PDF — for human review and record-keeping
Exports include all student, teacher, and usage data associated with the requesting district, including lesson completion records, assessment scores, and account information.
⚾ Data Deletion Upon Contract Termination
Upon termination of the contract between MoveWell and the school or district, all student data associated with that district is deleted within 60 days of the termination date.
Deletion includes all backups, logs, and secondary copies stored by MoveWell or any subprocessors. Upon completion of deletion, MoveWell will provide the district with a written data deletion certificate confirming that all district data has been removed from our systems.
Early Deletion Requests
Districts and schools may request immediate deletion of their student data at any time during the contract period. Deletion requests are processed within 14 business days and do not affect the terms of the service agreement.
Our commitment: When your contract ends — for any reason — your district's student data is gone from our systems within 60 days. No lingering copies. No data retained "for analytics." We provide written confirmation when deletion is complete.
⚾ Subcontractors & Third-Party Services
MoveWell uses a limited number of subcontractors to deliver the MoveWell platform. All subcontractors with access to student data are listed in our Data Processing Agreement, which is provided to districts upon request.
Current subcontractors with potential access to student data include:
- Cloud hosting provider (data storage and infrastructure) — data encrypted at rest and in transit
- Email delivery service (teacher communications only — no student data)
No subcontractor may use student data for any purpose other than providing services to MoveWell. All subcontractors are bound by data protection obligations equivalent to those in these terms.
⚠ For Districts Evaluating MoveWell
If your district requires a Data Processing Agreement (DPA) under SOPPA (Illinois) or your district's own procurement policy, contact us before contracting. We will provide:
- Our standard DPA template for your legal counsel's review
- Written documentation of all subcontractors with student data access
- Evidence of our security controls and compliance program
- Interview time with our technical team upon reasonable request
⚾ Content & Intellectual Property
All curriculum content (lesson plans, assessments, rubrics, standards mappings) created or provided by MoveWell is licensed to the contracting school or district for educational use during the contract period. MoveWell retains ownership of the underlying content and platform technology.
Schools and districts may:
- Use MoveWell curriculum content with their enrolled students
- Print lesson plans and materials for classroom use
- Share curriculum content with parents/guardians for at-home use related to enrolled coursework
Schools and districts may not:
- Redistribute MoveWell curriculum content to other schools, districts, or third parties without written permission
- Use MoveWell content to train AI models or for any commercial purpose
- Reverse-engineer the MoveWell platform or extract curriculum data for use outside the platform
⚾ Teacher & Administrator Accounts
Teachers and administrators create accounts using their work email address. Account holders are responsible for maintaining the confidentiality of their login credentials and for all activity under their account.
MoveWell reserves the right to suspend or terminate accounts that violate these terms, applicable laws, or the policies of the contracting school or district.
⚾ Service Availability & Support
MoveWell targets 99.5% platform availability. Planned maintenance will be communicated to district administrators at least 72 hours in advance when possible.
Technical support is available to district administrators and designated teacher contacts via email. Response times:
- Critical issues (platform unavailable): within 4 business hours
- Standard support: within 2 business days
- General inquiries: within 5 business days
